These Terms of Service apply to all design services commissioned through Hugo Rain Creative Digital Studio (hereinafter "the Studio") via our website or any other channel. By commissioning the Studio to provide design services, you acknowledge that you have read, understood, and agreed to these terms.

The Studio is operated by Huang Guan-Hong and provides digital design services including brand identity design, website design and development, website hosting and maintenance, social media asset design, print collateral design, and presentation template design. The specific scope, deliverables, timeline, and fees for each project are determined by the contract signed by both parties.

Project fee ranges: Brand Identity Design NT$ 20,000 – 60,000, Website Design & Development NT$ 60,000 – 150,000, Brand + Website Bundle NT$ 80,000 – 180,000. Website Hosting & Maintenance NT$ 1,000 – 10,000 per month, Ongoing Design Services NT$ 5,000 – 16,000 per month. Actual fees depend on project scope and are agreed upon by both parties.

A written quote is provided before any contract is signed. Payment methods and installment schedules are specified in the contract. Project fees are paid via bank transfer and are not processed through online payment platforms. Monthly and annual service fees can be paid online (processed by NewebPay) or via bank transfer. If an official invoice is required, an additional 6% (5% tax + 1% accounting) will be added. All quotes cover design services only and do not include printing, travel, product photography, stock assets, advertising, or other third-party costs.

Design deliverables are submitted according to the timeline agreed upon in the contract. The client must review and confirm deliverables or provide revision feedback within three days of receipt. If review exceeds four days, the Studio's next delivery date will be extended by the number of days exceeded. The number of revisions for each item is specified in the contract. Additional revisions beyond the agreed amount will be charged separately, and the Studio will notify the client of the fee and obtain approval before proceeding.

Upon full payment, copyright of all design deliverables transfers to the client. The Studio may not resell or transfer the work to any third party, but retains the right to use completed work in its portfolio, exhibitions, and social media for promotional purposes. If the project is terminated during production due to reasons not attributable to the Studio, copyright remains with the Studio. The Studio guarantees that all materials not provided by the client are free from copyright infringement. If materials provided by the client involve copyright or legal issues, the client assumes full legal responsibility.

Either party may terminate the contract by providing written notice at least fifteen days in advance. Payments already made are handled according to the contract and the Refund Policy. If the client delays payment for an extended period or refuses to review deliverables without cause, the Studio may terminate and require payment for all completed work.

In the event of force majeure (natural disasters, war, government policy changes, network failures, etc.) preventing either party from fulfilling contractual obligations, neither party shall bear liability for breach of contract, and both parties shall immediately negotiate alternative arrangements. Liability for breach of contract is limited to the total amount paid under the agreement. Neither party shall be liable for indirect losses or business losses.

The Studio reserves the right to modify these terms at any time. Updated terms will be posted on this website and take effect on the date of publication. These terms are governed by the laws of the Republic of China (Taiwan). In the event of any dispute, both parties agree to submit to the jurisdiction of the Taiwan Taipei District Court as the court of first instance. 本服務條款適用於所有透過雨果雨創意數位工作室(以下簡稱「本工作室」)網站或其他管道委託之設計服務。當您委託本工作室進行設計服務時,即表示您已閱讀、瞭解並同意本條款之內容。

本工作室由黃冠泓負責營運,提供品牌識別設計、形象官網設計與建置、網站維護與託管、社群素材設計、文宣設計、簡報模板設計等數位設計服務。各專案之具體服務內容、交付項目、時程與費用以雙方簽訂之合約為準。

專案費用範圍:品牌識別設計 NT$ 20,000 – 60,000、形象官網設計與建置 NT$ 60,000 – 150,000、品牌 + 網站整合方案 NT$ 80,000 – 180,000。網站維護與託管月費 NT$ 1,000 – 10,000,持續設計服務月費 NT$ 5,000 – 16,000。實際金額依專案需求與雙方協議而定。

所有專案於正式簽約前提供書面報價,付款方式與分期比例依合約約定。專案費用以銀行轉帳支付,不透過線上金流平台收取。月費與年費服務支援線上付款(由藍新科技 NewebPay 處理)及銀行轉帳。若需開立發票,將額外收取 6%(5% 營業稅 + 1% 會計處理費)。所有報價僅包含設計費,不包括印刷、出差、產品攝影、素材購買、廣告投放等第三方費用。

設計稿件依合約約定之時程交付,委託方應於收到稿件後三日內確認內容或提出修改意見,審核時間如逾四日,本工作室下次交稿時間依所逾日數順延之。各項目之修改次數依合約約定,超出約定次數之修改將另行計費,本工作室將於修改前告知費用並取得同意。

全額付款完成後,設計成品之著作權歸委託方所有,本工作室不得將作品轉售或轉讓予第三者,但保留將設計作品用於個人作品集、展覽及社群媒體展示之權利。設計製作進行中,因不可歸責本工作室之事由而終止時,著作權仍歸本工作室所有。本工作室擔保所有非委託方提供之素材均無侵犯他人著作權或其他權益,委託方所提供之資料若涉及版權或其他權益問題,委託方應承擔相應法律責任。

雙方可於書面通知後終止合約,至少提前十五日通知,已支付之款項依合約約定及退款政策處理。委託方長期拖延付款或無故拒絕審核稿件,本工作室可提前終止並要求支付已完成工作部分之費用。

因不可抗力事件(天災、戰爭、政府法令變更、網路故障等)導致雙方無法履行合約義務,雙方不承擔違約責任,應立即協商替代方案。因違約導致之賠償責任以雙方已支付總金額為限,雙方不對間接損失或業務損失承擔責任。

本工作室保留隨時修改本條款之權利,修改後之條款將公告於本網站,公告日即為生效日。本條款以中華民國法律為準據法,因本條款涉訟時,雙方同意以台灣台北地方法院為第一審管轄法院。如有任何疑問,歡迎透過 Email 與本工作室聯繫。

The Studio values your privacy. The following explains how we collect, use, and protect your personal information.

The Studio collects personal information through our website contact form (name, email, phone number, company name, and inquiry details), through contract signing (name, address, tax ID number, and bank account information), and through online payments processed by our third-party payment provider NewebPay. The Studio does not store credit card numbers or other sensitive payment information.

Personal information collected is used solely for responding to your inquiries and providing quotes, executing design projects and fulfilling contracts, sending project progress notifications, issuing invoices and processing payments, and complying with requirements from competent authorities as required by law. Your personal information is stored on cloud services with encryption protection. The Studio takes reasonable security measures to prevent personal data from being stolen, altered, leaked, or otherwise compromised. The Studio will not provide your personal information to third parties without your consent, except as required by law or judicial authorities.

This website uses the following third-party services: Google Analytics (website traffic analysis, collecting anonymous browsing data), NewebPay (online payment processing), Vercel (website hosting), and Supabase (database services). Please refer to each service's official website for their respective privacy policies. This website uses cookies to improve browsing experience and conduct traffic analysis. Under the Personal Data Protection Act of the Republic of China, you have the right to inquire about or request access to your personal data, request copies, request corrections or supplements, request cessation of collection, processing, or use, and request deletion. 退款政策

This Refund Policy applies to all design services commissioned through the Studio, including brand design, website development, website maintenance, and other visual design services.

If the client needs to cancel a project after signing the contract but before design work has begun, a refund of 70% of the amount paid may be requested, with 30% retained as an administrative processing fee. If design work has already commenced and the client needs to terminate the contract, payments are handled based on the proportion of work completed: 50% refund if no design draft has been submitted, 30% refund if a draft has been submitted but not finalized, and no refund once the design has been finalized and entered the development phase. These refund ratios are general guidelines, and specific amounts are determined by each project's contract.

For monthly or annual services such as website maintenance, fees already paid are refunded proportionally based on the remaining months. No refund is issued for any service month that has already begun.

Refunds do not apply in the following situations: all design deliverables have been delivered and confirmed in writing by the client; the project has been delayed by more than 60 days beyond the contracted timeline due to the client's own factors; or materials provided by the client involve legal disputes preventing the project from continuing.

Refunds are returned via the original payment method. If the original payment was made by bank transfer, the refund will be deposited into the client's designated bank account. Refunds are processed within 14 business days after confirmation by both parties. For any refund-related questions, please contact the Studio via Email. If both parties cannot reach an agreement, the Taiwan Taipei District Court shall serve as the court of first instance.

雨果雨創意數位工作室 退款政策

本退款政策適用於所有透過本工作室委託之設計服務,包含品牌設計、網站建置、網站維護及其他視覺設計服務。

簽約後設計工作尚未開始前,若委託方因故需取消專案,可申請退還已付款項之 70%,30% 作為行政處理費用不予退還。設計工作已開始進行後,若委託方因故需終止合約,已支付之款項依實際完成工作比例處理:設計未提稿退還 50%、設計已提稿未定稿退還 30%、設計已定稿進入開發則不予退款。以上退款比例為原則性規範,具體金額依各專案合約約定為準。

網站維護等月費或年費服務,已繳付之費用依剩餘月份比例退還,當月已開始之服務月份不予退費。

以下情形不適用退款:設計成品已全數交付且經委託方書面確認;因委託方自身因素導致專案延宕超過合約約定時程 60 日以上;委託方提供之素材涉及法律爭議導致專案無法繼續。

退款以原付款方式退回,若原付款方式為銀行轉帳,退款將匯入委託方指定之銀行帳戶。退款申請經雙方確認後,將於 14 個工作日內完成退款作業。如對退款有任何疑義,歡迎透過 Email 與本工作室聯繫協商,雙方無法達成共識時以台灣台北地方法院為第一審管轄法院。
